If an Item is exactly as you describe it and is fully working etc etc And a customer sends it back as faulty (When it is clearly not!) are they entitled to a refund? Personnally I think its because they get the item and then dont like it! Usually I refund but somehow it does not "feel" right.:confused:
Although it doesn't 'feel' right and it can be annoying/inconvenient ... it is the right thing to do to accept returns (in my opinion). :)
It depends if you're registered as a business or not.
If you are, and the item was bought on a buy it now (rather than an auction) then they can return the goods and ask for a refund for any reason they like, or indeed none at all. They are supposed to return the goods in a sellable condition, but I don't suppose the courts would take any notice of a seller claiming that they aren't sellable - and in this case the buyer is claiming they're faulty anyway.
Whilst I agree there are some dodgy sellers out there, I do think the distance selling regs have gone too far the other way.
If it was an auction, and you can bear the inevitable neg, you can tell them to take a hike. (Especially if they didn't pay by paypal - if they did, you might find you'll be giving away an involuntary refund anyway as paypal are notorious for just issuing refunds on a complaint from a buyer).

Do you have any specific returns T&Cs Nosty? I personally exchange or refund postage and item price if the item is faulty, if the item is not faulty, and the customer has just changed their mind, and the item returned in a resaleable condition, then I refund item, but not postage either way. That is an expense out of your hands.
If you have no specs, its all down to you and your customer to decide an amicable agreement I think.
There is no grey area, the distance selling regs apply to all businesses, there is a cooling off period whereby buyers can return goods for any reason they like. - But it applies to businesses, and does not apply to auctions. So if you sold it on a BIN and you're a business, you have to refund.

The things to watch out for are the terms Trader and Business as if you are a hobby seller (individual) then a lot may not apply. I find the whole thing very confusing. I don't think I am alone in that as numerous threads on the topic result in much disagreement of when and where these regulations apply.
I would return in minus shipping and auction costs
buyers like that want you to kiss there......if you don't they will leave you a very bad feedback if they do not get there way they have a temper tantrum jump up and down scream and hollar !! better off give them back there money minus auction fees and shipping and put them on your blackball list..
