DO I get a bad mark if i cancel sale and payment as seller wont respond to the 2 emails I have sent since 18th and yet money has been sitting in paypal since then but "Unclaimed" I want the goods as hard to find yet seller has not spoken at all. Can I just cancel sale and Paypal without repucussion? (Sorry for spelling)

Firstly i would cancel your paypal payment & get money back.
If the seller won't communicate with you, then unfortunately there isn't much else you can do.

Cancel the payment, leave negative feedback, report to eBid. These so-called sellers give the rest of us a bad name. :(
