    Default Act of God or Not...???

    just the thing to get you going....I am thinking along the lines of claiming on your insurance....if during a storm your house or something belonging to you is struck by lightning.....you put in a claim...the ins; company says it was an act of god...you say no it was not... so it ends up in court,,,has any company been able to prove the existance of god in their case against your claim....
    I know it is an excuse that has been used a lot , and seems to work,,,,but how....who is god..where is he so people can sue him....is there a god in an instance like this.....
    your thoughts on this please ????.......papa. ( by the way , I do not have any claim )

    Act of God is simply a phrase, not a literal assertion.

    Hi Kimbo , you and I seem to know or think that .... but if so ? ...how are claims thown out because of this.... if it is only a phrase.... the claimant should win....????

    It's a phrase with a legal meaning.

    Act of God

    An event which is caused solely by the effect of nature or natural causes and without any interference by humans whatsoever.


    Or, as set out in Tennant v. Earl of Glasgow, 1864 2 M (HL) 22:

    "Circumstances which no human foresight can provide against, and of which human prudence is not bound to recognize the possibility, and which when they do occur, therefore, are calamities that do not involve the obligation of paying for the consequences that may result from them."

    As I see it the term is practically Spinozan in concept. Thus purely Deist in vision.

    I don't think they try that here, if lightening hits the house they pay for it. But if the public sewer backs up or river rises, most US insurnace companies won't cover damage unless you have special flood insurance. And you can't buy it if your area is prone to flooding.

    But if you ever put in a claim, it can make your insurance go up. So many times you end up paying it all back in preiums anyway. Insurance conpanies alway's come out ahead, alway's. And they let other companies know, so you can't even change companies, even if you had a claim clearly shown as good in your policy.

    In our modern times "Act of God' should be changed to "Act of Weather" considering not everyone believes in God.
