Thread: Damage item through post

  1. #1

    Default Damage item through post

I have sent an item through the post, which when the buyer received it was broken.
I have spoken to the post office where i posted it and said about making a claim for it and was told becauase it was sold through an auction site the buyer would have to make the claim, as they need the damage item etc.
Now if i send buyer a replacement i am going to be losing out.
As i'm a private seller and not a business i think this is a bit strange!!

Never had to make a claim before!!!!

I think your PO might be talking rubbish. There is a special team for dealing with eby losses, but last time I looked the seller could still make the claim. I've not heard of this applying to any other site, even so. Contact RM customer services.

You can print a claim form off the Royal Mail site.

I did it a few weeks back. Eileen.

Buyer or seller can claim, But the packing & item must be kept for royal mail to inspect should they want to.

If you have 30+ minutes free ring RM customer service and ask them what the correct way to do things are if you need to.

Rather than printing off your own claim for just get one from the PO. The PO cannot refuse to give you a claim form.

Here in the states, if the item was insured, the damaged item, complete with packaging, needs to be brought to the PO to show it was damaged. Keeps the scammers from making false claims.

I got form from PO and when i went back in said that buyer will need to claim as they have item which is damaged.

    Will try and phone them.

Does make sence if they have the broken item though or it means paying out for more postagen to get it back.

Unless it's changed, it used to be as Rainy says - buyer has to keep item available for inspection, but seller can (and in my view should) make the claim.

A seller can make a claim, but how do you know the buyer's item is actually damaged. Either the seller must have the item returned to them, or the buyer must bring it to the PO.

Absolutely, the seller is the one who paid the PO to deliver. He entered into a contract with the PO to deliver the item (and exercise due care in doing so).
Don't put up with your post offices nonsense make a claim. All the buyer has to do is retain the packaging or give it back to you so the post office can inspect it.

You quoted the bit of my post that addressed that point: the buyer has to keep the item available for inspection, should RM choose to do so.
