Also I am sure I read someplace that both the AP and ebid had to approve you so just wondering on what basis

And if that is the right one then I think this answers my question

Locations. You may not place Links to an Advertiser's Website or Website content in third party newsgroups, message boards, blogs, unsolicited email and other types of spam, link farms, counters, chatrooms, or guestbooks. Publishers using IRC channels, instant messages or similar Internet resources must designate their program as special requiring manual review and acceptance by the Advertiser.

So it looks like blogs, p2p, forum links, and emails are out.

Still not sure about websites, as it does go on about tracking code, so maybe you need to ask them before signing up but not sure how, as their contact us shows address' and phone numbers but, can't see an email address.

I do understand why people do not want to hand over their data for no purpose with these things, as data gathering and sale of the same data by marketing companies is the pain, of a thousand cold calls, or if they send it out to the wrong people then it can be a lot worse.
