    Default RM theft trace

What is it? I cannot find any information on Google.
Basically, I bought something (for £7) on the other side which didnt appear (I have waited almost a month), and the seller is saying they cannot give me tracking (though advertised as sent with tracking) and will need to open a "theft trace" with Royal Mail, which is something different, they said, than a claim, and involve the police and whatnot?
I have never heard of this "theft trace" thing before.

You should not be doing anything of the sort.
The contract that was made with Royal Mail is with the sender of the package, not the recipient. You have neither obligation nor legal right to open any sort of case. You can, however, respond to requests for more information from either party should such requests be made.

My advice is that you tell them straight that they either sort this matter ASAP or you'll start an official claim against them.

I think that they think you have the item and are trying to scam them and they are trying to frighten you into saying so by saying the police will be involved. Start an INR in paypal if they don't have a tracking number you should get your money back no problem.

Agree with buttons, open an 'item not received case' either in feebay or paypal.

    Damian is right:
Your contract is with the seller - you pay, he delivers.
He has a contract with RM to make the delivery on his behalf.
So a non-delivery is a problem between the seller and RM. It is nothing to do with you.

The seller can claim for loss with RM after 15 days, and should have done by now.

You should contact the seller and ask for an immediate refund.
If it isn't immediate, go for a Item Not Received claim with FleaBay.

He may not have sent it at all, and may make a habit of this. Your claim will alert TOS to his practices, if that is the case.

Mhm, he cannot provide tracking to me, but says RM can trace it so it sounds more and more like some kind of diddle.

I've never known RM trace anything that had got lost. They usually just pay up.
But that's irrelevant to you - the delivery contract is between the seller and RM, and for him to deal with.

You need to time-limit the rest of the transaction, after which you want an immediate refund.

sounds like a plan. I am quite happy to work with them up to a point but obviously this all seemed a tad fishy...
